United States Attorney Brendan V. Johnson announced that a McLaughlin, South Dakota, man charged with Assault by Striking, Beating and Wounding was sentenced on March 22, 2012, by United States Magistrate Judge William D. Gerdes. Kyle White Bull, age 25, was sentenced to 6 months in custody and a $10 special assessment to the Victim Assistance Fund.
Kyle White Bull was indicted for Assault with a Dangerous Weapon, Assault Resulting in Serious Bodily Injury, and Aiding and Abetting by a federal grand jury on October 12, 2011. He pled guilty to a superseding information that charged him with Assault by Striking, Beating and Wounding.
The conviction arises out of a June 9, 2010, incident in which Kyle White Bull and friends were driving around McLaughlin. At some point they drove to a place near McLaughlin known as “Honkey Tonk” junction where an argument ensued. White Bull and two others assaulted the victim, who was an adult male. White Bull pled guilty to assault by striking, beating and wounding on March 22, 2012.
This case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Agency. Assistant United States Attorney Mikal Hanson prosecuted the case.
White Bull was immediately turned over to the custody of the United States Marshal to begin serving his sentence.
